What is the European Union third Directive?

The European Union third Directive 2006/126/EC (the Directive) requires all Member States tochange their driving rules by 19th January 2013, to:

•Introduce administrative validity periods for driving licences;

•Require new minimum ages for obtaining certain categories;

•Ensure drivers of goods and passengers carrying vehicles comply with minimum standards ofphysical and mental fitness;

•Strengthen the principle of progressive access to two-wheeled vehicle categories;

•Introduce a new category for mopeds and motorcycles and amend existing categorydefinitions to reflect technical characteristics.

The Directive will also introduce a single driving licence model across Europe which will in turn:

•Reduce possibilities of fraud;

•Guarantee a true freedom of movement for EU drivers; and

•Reinforce safety on European roads.

Why change?

•Analysis of the strategic justification for this initiative shows that compliance withthe Directive is a mandated requirement for the Department as well as for DVLA.The implications of not delivering the required system and business changesinclude substantial financial penalties, damage to our reputation and withdrawalof drivers rights for British licence holders in Europe.

•DfT is co-ordinating DVLA and DSA Policy implementation of national legislation tosupport the changes.

•The British government has committed to complying with the requirements of theDirective. DfT is leading a programme of work to introduce the changes in GreatBritain through two projects – one at the DSA and one at DVLA.

How does it affect drivers in Great Britain

•New rules do not take away entitlement to driveif granted before 19 January 2013

•If you update your licence on/or after 19 January2013 you will receive a new format drivinglicence

•Some vehicle categories you are entitled to drivenow will be shown differently e.g. Where B1 heldpreviously A79(tri) will now also be shown tocover the tricycle element. Where full ppreviously held this will be retained and AM andq will be added.

•Introduction of 10 year (max) licences for car,motorcycle and small vehicles (ODL).

•Introduction of 5 year (max) licences forvocational drivers. Not all vocational drivers willhave a 5 year licence. You will not be able to tellfrom looking at the 4a and 4b which regime thedriver is in because the 4a (licence issue date)changes each time a new licence is issued, itdoes this to show the AVP start date.

•The new rules will apply for all newentitlements and for any test passes from 19January 2013 onwards.

Motorcycles, Mopeds and Tricycles

Category AM

• Moped. Two wheeled vehicles or three-wheel vehicle with a maximum design speed over 25km/h and not more than45km/h (instead of 50km/h under category p)

•Light quadricycle. With an unladen mass of not more than 350kg, not including the mass of the batteries in case of electricvehicles, whose maximum design speed is not more than 45km/h

•Wherever AM is shown q will also be seen. If full p held previously this will be retained, if not only AM and q will be shown.

Category A1

•A motorcycle with a cylinder capacity not exceeding 125cc, of a power not exceeding 11kW and with a power to weightratio not exceeding 0.1kW per kg.

•A motor tricycle with power not exceeding 15kW

Category A2

•A motorcycle of a power not exceeding 35kW, with a power to weight ratio not exceeding 0.2kW per kg and not beingderived from a vehicle of more than double its power.

Category A

•A motorcycle of a power exceeding 35kW or with a power to weight ratio exceeding 0.2W per kg.

•A motorcycle of a power not exceeding 35kW with a power to weight ratio not exceeding 0.2kW per kg and derived from avehicle of more than double its power.

•A Motor tricycle with a power exceeding 15kW.

•A test is no longer available in A restricted to 2 years (up to 25kW). Category A restricted to 2 years passed prior to19.01.13 will retain growing entitlement and can ride category A unrestricted after 2 years experience

Drivers of buses and lorries (medium and largegoods and passenger carrying vehicles)

•On or after 19 January 2013, when a driver passes a driving test or renews their full drivinglicence in categories C,C1,C1E,CE,D,DE,D1 or D1E , their licence will be valid for a maximumperiod of 5 years, up to age 65.

•Drivers over age 45 (or next renewal) will need a medical examination and a completed D4medical examination report at each renewal of their vocational entitlement (max 5 yrs) andwill need to supply a new photograph every other licence renewal (10 yrs)

•Drivers under age 45 will need to sign a self declaration of fitness to drive at each renewal oftheir vocational entitlement (max 5yrs) and will need to supply a new photograph everyother licence renewal (10 yrs)

•From 19 January 2013, the minimum age for categories D and DE will increase from 21 to 24years for non professional drivers. See Note 5 on category table (INF245) for professionaldrivers.

Trailer restrictions for car and/or small vehicle drivers

•Drivers passing a test to drive cars and/or small vehicles up to 3500kg (category B) on or after 19 January2013 will be restricted in the size of trailer they can tow.

•Category B

- Motor vehicles with a MAM not exceeding 3500kg and designed and constructed for the carriage of nomore than 8 passengers in addition to the driver with a trailer weighing up to 750kg.

-Motor vehicles with a MAM not exceeding 3500kg and designed and constructed for the carriage of nomore than 8 passengers in addition to the driver with a trailer over 750kg where the combined weightof the towing vehicle and trailer is not exceeding 3500kg.

•To tow more than 750kg where combined weight of vehicle in category B and trailer exceed 3500kg afurther test in category B+E is required. This entitlement allows trailers weighing up to but not exceeding3500kg and the combined weight does not exceed 7000kg.

•To tow trailers weighing more than 3500kg with a car and/or small vehicle with a MAM not exceeding3500kg (category B) drivers will need to pass a test for category C1E . The combined weight is limited toMAM 12000kg.

•The Directive adds an option for customers who want to tow a trailer over 750kg where the combinedweight of the vehicle and trailer is over 3,500kg (up to a maximum of 4,250kg), but who don’t want totake a B+E test. These customers can apply for an additional entitlement against their category B that willbe shown as a new Community code 96 on the licence . GB has not taken up this proposal.

Trailer restrictions for car and/or small vehicle drivers

Maximum Authorised Mass (MAM) is the maximum weight of a vehicle or trailer including themaximum load that can be carried safely while used on the road.

Holders of driving licences issued in other EuropeanMember States

•If you hold a licence issued in another country in the European Community/European Economic Area(EC/EEA) you can already drive using your licence providing it remains valid. These rules remainunchanged.

•The Directive sets the minimum age at which we can drive vehicles but sometimes allows countries to seta higher or lower age for driving within its borders. If you are the holder of an EC/ EEA licence and arebelow the minimum age set for driving in the UK, but meet the minimum age quoted in the Directive, yourlicence will be valid for driving. This would happen where the UK has taken up the option to set a higherminimum age restriction. However, if you wanted to exchange your licence for a GB one, you would haveto wait until you meet the minimum age set here.

Who does this affect?

•Holders of driving licences issued in other EC/EEA countries – this will affect you if you visit or come to livein Great Britain from 19 January 2013. Where the UK may have chosen to put the UK age up from the onequoted in the Directive, but the EU visitor is from a state which chose to issue a licence with the standardDirective minimum age. In those cases, we would have to allow the driving at the standard directiveminimum age.

•Some EU countries will be taking up the option of B96, GB will not offer tests in this category. However, wedo recognise it and will exchange this entitlement where it is held.

The new driving licence card design explained

•On or after 15 October 2012, photo card driving licences issued by DVLA will be in a newformat. This will accommodate changes from the new EU3D rules which come into force on19 January 2013. Current format licences will still be valid and will be replaced gradually asthey are renewed and updated.

•The new style photo card licence will look different to the current licence. It will display acategory table which gives all possible driving entitlements on the back and the base carddesign will change.

•Vehicle categories the holder is not entitled to drive will be scored through with a continuousline making it clear which are valid for driving and which are not.

NB: If there is a date against the higher entitlement, the holder will be entitled to drive the lesserentitlements.

•For a short period of time from 15 October 2012, DVLA will use existing card stocks to printthe new licences. Once the existing card stock is finished, the new base card will be used.Therefore, between 15 October and mid December 2012, drivers may be issued with eitherdriving licence design (see overleaf).
